you can still buy catergory c damaged commercial vehicles and some not all dont have to be inspected last 2 ive bought ive applied for log book and not shown anything against when selling the vehicles im always up front that they have been repaired and any pictures are shown theres a loop hole though if the buyer dosnt ask you about previous damage you are not obbliged to tell them depends how up front and honest you are but if you do your home work right you will probably take some one to look for you and a hpi report before you hand your cash over

You are obliged though surely, if you sell a vehicle knowing that it has had serious accident damage repair and don't declare it to the prospective buyer that's fraud I would have thought, i.e. omitting facts that affect the value of the vehicle. That sort of thing is no different than "clocking", i.e. increasing the resale value.
It's the reason why the HPI checks are done by the auction houses. I mean, no doubt, people try it on, but if it can be proved subsequently I wouldn't want to be in the vendor's shoes...

As said, there may not be a specific paragraph stating "you must declare all damage", however, wilfully failing to inform a purchaser (depending on the extent) would probably be declared as fraud, especially a trader...

9 out of 10 traders wont entertain a car with any history especially something which has been catorgarised by an insurance company yes you have your rights when buying from a trader or a car pitch but most of the damaged stuff is sold privatley this is how genuine honest people get ripped off not bought any salvage for a while now its full of our eastern european friends from over the water its going down hill rapidly the government has only just opened its eyes to cat b cars this means break only being taken out of the country then being brought back and reregistered in england again as a straight car now thats what you call a loop hole but like dave says in the post the loose is tightening now

A private man does NOT have to tell a buyer that the car is on HPI ,But it is an offence for a trader not to tell a buyer

If people spend a lot of money without checking it themself tho then they are idiots

anyone can do a HPI check on there mobile phone now so there is no excuse for getting caught out

******* new just had letter from hpi and its a no go now ******

As above the have been piloting it with a few dealers for a while now and due to problems with HPI and Audatex the accident repair centre estimating system they have given up on it now , Great all Vehicles subjected to CAT D or C will still be declared as they well should be on the data base

Reason I am interested in this is because a friend of mine is buying a Merc CLK Convertable on a Cat C. He is planning on repairing it then selling it on without mentioning the Cat (Which I strongly disagree with) He is on about this company (Told to him by his insurance company no less) that can remove the Cat C so nothing shows up when the car is HPI'd.

I would have thought this was illegal??? I would be very p1ssed off if I bought a car after it was HPI'd only to find out that it had been an insurance write off!!!

As Paul said it cant be removed from Cat D or C on HPI even when a vehicle has had a VIC check this seen on HPI also shows on the bottom of V5 document now so its a must this has to been viewed ,

Only if it has had a VIC Check, I will say "substantially damaged & repaired" which only applies to Cat C, Cat D does not require a VIC Check

Commercials dont come under this scheme so dont need a VIC Ever.

I have bought a few cat C & D over the years, I broke the C's & Repaired and declared the D's

But the system is only as good as the data input. Last year I bought my daughter a Cat C VW Beetle that had a grazed bumper & wheel arch, I was anticipating that it would need inspecting but wasn't bothered as it wasn't going to be sold anyway!

To my surprise the damage was recorded with the DVLA & HPI on a private plate which didn't come with the car! Once I received the original number plate I telephoned the DVLA to book the VIC and they said that it wasnt recorded with them, so I was able to apply for the V5 in the normal manner (V62) I have since HPi'd it twice and doesnt show the damage. Infact the only thing that shows up on the history is the plate change!

So how many others have slipped through the net???
