if he had came for the car and it was not as described iwould of thought it would proper to give it back but to send deposit then not appear and ask for it back i dont think so
Depends on the size of the deposit, a £100 or 2 yes but a big deposit I would return minus hassle costs, just for pure decency
Yes he has messed you about but would you like to lose ££££'s unless you stated the deposit was non refundable you would be hard pushed to keep it legally
On keeping the deposit....A deposit is only a holding fee....If it goes to a small claims court you will have to give it back...Thats why you have to state it as a downpayement as in a payment on the vehicle and state what is left to pay....even then it is dodgy...Did you give him a receipt????
tell him you will keep the deposit until the car is sold or you could let him take you to the small claims court.whats the worst that can happen..you may have to give him the money back...at least you will be wasting some of his time as he did yours!
When he said he wanted his money back I immediately offered him half (£1000) which he refused.
I think this was more than fair as I had agreed to do extra work on the car for him which the other interested party did not require done. the Irish guy was the first to send the deposit. (the other guy has now bought another car so this buyer is out of the picture)
I even took the day off work to drive to South Wales to pick up the parts for the work he wanted done, when I got home I then drove the car 40 miles to the garage who would do the work, with my wife in her car to bring me home.He then wanted me to deliver the car to the NEC for him I asked how I was supposed to get home from there (some 100 miles )
I have had to re-insure the car and Tax it for the trip to the garage.
The work being done will amount to just over £500 plus my insurance Tax (yes I can surrender it but will lose a month)
I still have to go and collect it from the garage.
Yes the car will have some more works bits on it but I didn't have to do this as it wasn't advertised with them.
I also paid £90 to two websites for adverts (it sold from the free one P.H.)
He insisted it was removed from all sites which I did.I now have to do it all again!

I think you've been more than fair with him in doing the extra work that he requested.
As you have have had the unwanted extra costs then it is not unreasonable to expect to retain some of the deposit.
I personally would not have given him back any of the money as you also had another interested buyer who has bought another car as yours had been sold.
