    motor vehicle insurance – dispute over insurer’s valuation – classic car insured on ‘agreed value’ basis
    When Mr H bought a classic car, he took out a motor insurance policy on an ‘agreed value’ basis rather than on the more usual ‘market value’ basis.
    Such policies are generally taken out only by owners of classic or particularly valuable cars, where the value is unlikely to depreciate substantially – if at all.
    The value of the vehicle is agreed in advance and insurer is then obliged to pay that amount if the car is lost or damaged beyond reasonable repair. However, the insurer is not obliged to pay for the replacement cost of the vehicle.
    Mr H agreed the value of his classic car under this policy was £2,500. Unfortunately, the car was badly damaged when Mr H was involved in an accident. The insurer took the view that it would cost more than £2,500 to remedy the damage, so it offered him £2,500, in settlement of the claim.
    Mr H thought that this figure was far too low. He told the insurer that, bearing in mind the good condition of the car before the accident, it would cost between £4,000 and £5,000 to replace. He therefore wanted the insurer to pay that amount.
    complaint not upheld
    We noted that Mr H had renewed his annual policy twice – on the 'agreed value' basis – before the claim in question. The policy terms, which had been clearly stated in the policy documents, said that Mr H was entitled to receive the ‘agreed value’ of the car – not the cost of replacing it. So we told him we could not uphold his complaint

    the man in question valued his car to cheap he should have done a bit more research into the value of his car so he got the agreed value exactly what was written on his insurance document

      The point was the insurance were obliged to pay the Agreed Value as a reasonable repair was more expensive

      I dont call a (apprx £2.5k) roof replace on a £7k car unreasonable ?

      So why has enginneer written it off then ?????

      Something isnt adding up - I'd keep a careful check on the figures if I were you

        I hit a car in the back ages ago in the RS2 and mine was writen off because there were no new parts available in oZ to fix it. All I did was push the front rad support panel in, 2 small tears on the nosecone and needed a new radiator. I bought it back and repaired it and it was back to looking good soon after.
        At least you can get a new roof panel over there, dunno what would I'd do if it happened here!
        But it back and get it done yourself. It's too good to lose.

          Would an origonal ford roof pannel be available? if not wouldn't they write it off on that basis? i can't any approved repairer using a S/H pannel

            I'm sure Express panels do brand new roof skins if it came to the issue of second hand parts.

            I would ask for a second opinion as it sounds as this bloke don't know his onions , can you not ask Escort-Tec for a estimate of repairs to do the roof and submit this to AON, as they have done this before I'm sure they could give you a very good/true price of what the repair will be

              insurance claim

              I Know The Guy How Came Out To Look At Your Motor Mate And I Can Tell You He Is No Muppet! He Ask Me Yesterday What I Thought The Value Of Your Car Was And I Said It Would Be At Leased £8000 ! It Is Not As Easy To Put A Price On A Classic Car As It Is A Modern Car As They Can Be More Easly Replaced ! My Advice Just Stick To Your Gun's I'm Sure It Will Get Sort !

                By all means settle for a cash in-lieu of repair basis but on the understanding it is NOT written off.
                just had a phone call of the insurance man going to send another man out and it looks like it will be a cash in lieu settlement and i keep the car so i will see what the offer is

                      I reckon you will be offered £1500 as a cash in lieu of repair payment

                      You may well hold out for more but not sure much more will be offered

                      as I see it as

                      20 hours labour @ £30 per hour = £600

                      Express roof panel = £600

                      Paint and materials = £300

                      Obviously VAT must be considered also your excess will be deducted from final payment

                        think youve got a good scrap price there son!!!

                        being serious though you need to resolve this rapidly otherwise you will miss out, dont think advertising the fact on forums is to good though, imo.

                          i know it aint on the same parr as the mk2 but a lorry hit my mk6 escort and they said that it was a write off and they valued the car at £1100 and that will give me £1000 plus the car back

                            So that is £100 for the scrap value of the car

                            At todays prices that is a bargain

                            Local scrap dealer is offering £20 a tonne for "mixed scrap" ie cars etc

                            6 months ago it was £230 per tonne

                                There are a few inconsistencies in this post, so I thought I would throw my opinions in !

                                1, The value is agreed at £7k, this is non negotiable as your premium has been paid on this value ever being paid out, obviously less xs.

                                2, If its a total loss then yes cat c/d (salvage) will apply. In this case it would be a d bearing in mind the opinion costs involved.

                                3, The engineer can total loss a car ON ANY COST OF REPAIRS if this involved a structual panel being replaced on a car with second hand parts, because a genuine is unavailable. He can authorise non genuine items if these are available and the customer agrees.

                                4, A cash in lieu would be the best option for you. Forward a copy of the estimate to him and request 100% full reimbursement. You will not be paid vat, unless you are vat reg and this will only be after the invoice has been settled with proof of payment. If this is the preferred route, then make sure it doesnt end up on the total loss register as it was previously deemed a total and some claims handler may not see the amended report.

                                5, Accept the first offer if you feel its right. Only you can make that decision.

                                6, When I value or research classic cars, I look at owners forums such as this and see what the values are and also read the threads, so be nice, you never know.......

                                7, Be polite, approachable and fair minded. Approach this bloody minded and he will leg you over just for the hell of it.
