  • ripped off-- advise please.

    advise needed please on my next course of action. involves an escort "enthusiast", but he is NOT a member on here.

    a couple of lads off here have been helping me out on this, but now seem to of come to a dead end.

    about 2 weeks ago, i agreed to buy a high spec pinto from a lad in northern ireland. he seemed a very genuine lad, and very knowledgable and clued up on pintos. his car and engine were in an escorts specialists in scotland, getting work done on it. all the running gear had been removed, as the shell was getting work done to it.
    he owed the owner of the garage just over £3k for work on his shell. i had agreed to pay £1500 for the running gear, which i would pay direct to the garage owner, to pay off part of the lads bill.
    for this, i was getting a freshly rebuilt all steel 2.1 bottom end, (alledgely built by ron harris) b.v.h. twin carbs, gearbox, rad, ignition, 2.5" manifold and system, basically everything to drop straight in and go.
    he had all recipts for work on the engine, and a rolling road print out of 197bhp, which he would forward on to me, once i had collected the engine.
    arriving in scotland to collect it, the fella from the garage seemed a nice chap, showing me round his workshop, and some of the cars he was working on. the engine looked ok from the outside, still had gearbox bolted to it. everything looked ok as far as i could see, although some of the parts were missing, which the garage owner said he would send down to me, once he found them in his workshop. ( just small bits, like starter motor, radiator)
    on arriving back home, i took the gearbox and clutch off. i was a bit shocked to find the crank was not a steel one. ( 6 bolts, not 9 as a steel crank) at this point, i took the head off, and discovered it did not have forged pistons either. but it did have a chunk missing from one of the standard pistons.
    i rang the lad in ireland straight away. he said there must be some mix up, and the fella in scotland has given me the wrong engine. i had to wait then until the following tuesday, to get hold of the fella in scotland.
    he confirmed he had given me the correct engine,and to persue the lad in ireland for my money back. after a few heated phone calls, and the threat of legal action against him, he has basically said, " see you in court then".
    he claims, once the engine was in my possesion, i could of done anything to it. it could of been me who has swapped parts over, and i am trying to scam my money back off him .
    thought about going through the money claim online site, but for this, i can only claim against someone in england or wales, not ireland or scotland.

    that brings me to where i am now.
    do i try legal action (will cost me, and i am now skint, with no guarantee of success)
    do i brake the motor for parts. got good carbs, sump, gearbox, head which i could sell. will get some money back, but not £1500 s worth.
    i cant exactly go knock on his door, but i will if i'm in ireland next year.
    i now have a car in the garage with 2 broken engines. along with other problems at home, this i did not need. a bit peed off with the escort scene too.

    i know now i should of took spanners with me and stripped it up there, but everything sounded genuine. hindsight is a wonderful thing.

        sounds like a shit situation to me mate, im sure theres many lads on here who have been in this situation, good luck with it!!!

        think a name of the garage could be worth it, as we dont want to end up in the same situation

                      correct.

                      although i now have my doubts, someone has pulled a fast one on me.
                      the irish lads shell and parts have been in scotland since july last year.
                      the escort specialist has given him until christmas, to clear his bill and collect his shell, or it will be sold on his behalf,and his bill settled. the shell has appeared on ebay a couple of times, but never met reserve.
                      i have also asked the escort garage if he would re-fund me, and put back onto the lads bill, but this was a no-no.

                        tried. basically my word against his now, as the property is in my possession, i could of tampered with it.

                              I was reading a which magazine in the hospital waiting room yesterday and there was an article on claims think it was about June the mag was from and i'm sure i read that you can go through a small claims court for up to £500 i think for a cost of £12 and up to £3000 for £44

                              This was the situation in Scotland but it did go into detail of England ,Ireland and Wales aswell

                              Maybe worth a look
