    Hi,

    I bought something off someone who used to be on this BB quite a lot some time ago and its never turned up. He says it was posted but nothing he can do as its the post office who have lost it.
    Cost me quite a bit of money too.
    Just wondering what my rights are or if there is anything i can realistically do?

    Its strange cos some parts turned up but not all of them and now we can't get any answer to emails etc off him so any ideas guys?

      All items sent via Royal Mail are insured for £36 as standard and its the sender who can only make the claim as its them who took the contract out with Royal Mail but they must still have the proof of posting receipt.
      Any items with a value over £36 should be insured using one of the other products, best ask at the Post Office when posting.

      As for what you can do, have you got this persons name and address, if so try writing them a letter and post it via Royal Mail Special Delivery as they have to sign for it.
      If you get no joy take them to the small claims court, think it costs you between £10-20 to do this but citizens advise bureau will give you help on this.

            He might be innocent i agree but he hasn't replied to mail for two weeks now and the original problem started months ago so plenty of time to sort.
            It was a center console so not something small and easy to lose.

            My Dad has written one more time to him so will see if he replies but if not will have to decide if to go through other means etc.
            Wouldn't mind if it was just a few quid but for me it was expensive and i bought it out of my own money for my dads car so its annoying if i just have to lose the money etc when i don't exactly have loads to start with.

              well speak to one of the folk who know him well or who live near him and ask them to have a word or get is number off some one once youve tried other means he also must have a postage receipt from when he posted it so he can proove that he sent it if he can not show you one then you know hes fibbing

                i'd say its the sellers problem

                he should of sent it a trackable/insured method, always send things this way to cover your back

                if it doesnt turn up, he should refund you, as he didnt send it the right way. only send things normal post if they have no value.

                only way it would be your fault is if you refused this type of delivery due to costs/not being in/etc

                    seems to be getting worse for these sort of things going on. thats why i always try and collect, things may have to be payed for then left for a few months while im away but at least you have piece of mind.. is it possible hes away, specially if hes not replied to emails fora week or so?

                        As said above it is the senders responsibility and if it doesn't turn up then he is liable.

                        If it the same person who I think it is I know of a couple more items that he has 'posted' which have failed to turn up and no response from the seller or refund given
